Florida's state and federal law enforcement aggressively investigate and punish drug trafficking. Charges for drug trafficking do not only apply to large drug manufacturing operations but to any selling large enough amounts of an illegal substance. A conviction for drug trafficking results in life-changing consequences such as prison time and expensive fines. If you have been accused of drug trafficking, you must retain legal counsel immediately to protect your future.
Butanediol is a thick, colorless solvent used to manufacture certain types of plastics. People illegally use it recreationally as a depressant with effects similar to alcohol or GHB. Florida Statute 893 states that if the prosecution proves that you knowingly sold, bought, manufactured, delivered or imported a kilogram or more of Butanediol into Florida you can be convicted of Butanediol trafficking.
Butanediol trafficking is a first-degree felony with penalties depending on the quantity involved. Other factors may result in even more prison time, such as prior drug convictions or firearm possession while engaging in the alleged drug trafficking. If convicted of trafficking 1 to 5 kg of Butanediol, the mandatory minimum prison sentence is 3 years with a $ 50,000 fine. For trafficking 5 to 10 kilograms of Butanediol, the mandatory minimum prison sentence is 7 years with a $100,000 fine. Those convicted for trafficking 10 kg or more of Butanediol faces a mandatory minimum of 15 years in prison and a $500,000 fine. If you knowingly make or traffic in 150 kg or more of Butanediol into Florida and you know that the likely result of your actions is the death of someone else, you can be charged and convicted of the capital felony of manufacturing or importation. Possible penalties for this crime are life in prison without eligibility for parole or a death sentence.
It is important to know that even if you simply agree or conspire with someone who is trafficking Butanediol, you still may face first-degree felony charges. It is commonly assumed that helping is not the same thing as actually trafficking; however, under the law, you face substantial penalties for both.
